When you see the headline “cannabis legalized” you have to take into consideration exactly what that means for where it is you find yourself located in the world.

Types of cannabis legalization

From country to country, and even city to city, the rules on canna can be as varied as your strain choices. It’s always a good idea to do a quick search on local laws before you light up or pack your bags. Let’s dive into the different types of cannabis legality.

Green light: Recreational legalization

In some places, cannabis is as legal as a cup of coffee. This means adults can legally buy, possess, and use it for both medical and recreational kicks. These areas have set up shops with regulated markets where a cannabis product label mirrors something you’d find on the back of a cereal box.

Examples: Certain US states like Colorado, California, and Oregon and countries like Canada or the Netherlands

Yellow light: Legalization, decriminalization, or a medical pass

Legalization with restrictions on public sales is like rolling through a yellow light. Approach with caution, and make sure you understand the laws thoroughly in these areas. For example, in Spain, you're only allowed to smoke weed in private spaces and if caught in public you might face fines or education programs instead of jail time. To add to that, the recreational sale of cannabis is also not legal in Spain which means you have to get your canna by growing it or from a cannabis social club. It's a middle-ground approach, where the law gets a little bark, but no bite.

In some places, the approach to cannabis has shifted towards decriminalization, which typically means replacing criminal penalties with civil fines. This policy change is significant as it aims to reduce the burden on the criminal justice system and focus on more severe crimes. Under decriminalization, being caught with small amounts of marijuana (even in private) might result in a monetary fine rather than arrest or jail time.

If medical cannabis is legal where you live you’ll need a doctor’s note to get canna. These areas recognize the healing powers of cannabis, prescribing it for conditions like chronic pain, anxiety, and more. It's a green pass for health, but these regions aren’t quite ready for recreational shops on the corner.

In some parts of the world, cannabis is still in the No-Go Zone. These areas have strict anti-cannabis laws, and getting caught with them can lead to serious consequences. These countries prove that the global cannabis conversation is far from over—there are still plenty more chapters to get through.

List: Any areas that fall under the federal law of the USA and countries like Russia, China, Japan, South Korea, Saudi Arabia- If you do anything DO NOT possess cannabis in these areas. You may face high fines or even jail time!

Cannabis legalization trends

To achieve full-blown cannabis legalization—a scenario where dispensaries can sell cannabis for profit—countries typically embark on a progressive journey like this:

  1. Initially, decriminalization serves as the gateway step, allowing societies to test the waters of cannabis acceptance tentatively. This is akin to a government and its people dipping their toes in the pool before taking the plunge.

  2. Once decriminalization has happened activists usually push the government to legalize medical cannabis. Once medical cannabis is legalized and the therapeutic benefits of the plant become more recognized and validated, the stage is set for broader societal acceptance and this lays the groundwork for potential recreational legalization.

  3. This is where things get cool. The move to recreational cannabis laws typically starts with the basics—allowing adults to enjoy a little herb in the privacy of their homes. From there, the government and society are ready to move to accepting the legal sale of cannabis.

From its criminal days in the distant 1913 to the start of its decriminalization in 1975 through the Compassion Act of 1997 (legalizing medical marijuana), and to full legalization in 2018, California has been a prime example of this process in action. Growing up in California in the late '90s and into the early 2000s, I had a front-row seat to the final acts of this saga. And let me tell you, I couldn't be happier about the time and place of my entrance to the world.

With that being said, the path to full green light legalization is complex and anything but uniform. Laws can vary dramatically within a single country, or even between different cities as also in the case some Californian cities still prohibit the sale and/or consumption of cannabis. Another example is the Bavarian ban on cannabis at Oktoberfest in Germany, despite the country's recent legalization of recreational cannabis. This patchwork of policies underscores the need to do your homework on the local green scene wherever you plant yourself.
